Terms of Service

1. Agreement to Terms

By accessing or using SelfScale ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

SelfScale is a product of SelfScale Inc ("we," "us," or "our"), a Delaware corporation. These Terms govern your use of our web application and related services.

2. Description of Service

SelfScale is an AI-powered content creation platform that helps users create, manage, and publish content for their personal brand. Our services include:

  • AI-generated content based on your voice profile
  • Content scheduling and publishing to social platforms
  • Voice profile creation and management
  • AI avatar video generation
  • Analytics and performance tracking

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this age requirement.

4. Subscription and Payment

4.1 Free Accounts and the Free Trial

Creating an account does not by itself give access to the Service. To use the Service, a new account starts the 7-day free trial with a card, or buys a paid plan. New accounts do not receive free credits at signup. Credits already in an existing account are not affected. Your account balance shows your available credits.

New accounts can start one free trial, on the monthly Standard and Premium plans. Power has no free trial and starts paid. The trial requires a card and lasts 7 days from the moment you complete checkout. The trial includes 47 free posts + 15 credits. Free posts are drafts SelfScale writes for you during the trial; once they are used, each draft uses credits. You are not charged during the trial. Unused trial credits expire when the trial ends, whether or not you continue.

Unless you cancel before the trial ends, your subscription continues automatically on the plan you chose. Your card is charged that plan's monthly price when the trial ends and again each month until you cancel: Standard is $29 a month with 50 credits, and Premium is $99 a month with 300 credits. Each successful monthly payment adds that plan's monthly credits to your account. Your plan is never upgraded automatically. The offer and billing terms presented at checkout govern your subscription; existing subscriptions keep their agreed terms.

4.2 Paid Subscriptions

Subscriptions without a trial charge your payment method immediately and start the same day. For subscriptions with a trial, the first subscription charge occurs when the trial ends unless canceled before then. Subscription fees are billed in advance on a monthly or annual basis, as shown at checkout.

4.3 Billing

By providing payment information, you authorize us to charge your payment method for all fees incurred. We may change our prices, the credits included in a plan and the number of credits a feature costs. The price for a new subscription is the price shown at checkout. We will notify you before a price change applies to a subscription you already have.

4.4 Cancellation and Refunds

You may cancel at any time in Settings using Manage Billing, which opens our payment provider's billing portal. Cancellation takes effect at the end of your current trial or billing period, and you keep access until then.

If you cancel before the trial ends, you will not be charged. Unused trial credits still expire when the trial ends. We do not provide refunds for partial billing periods.

4.5 Credits and Top-ups

Credits included in a plan are added each billing period. Premium and Power credits reset each month on your billing date and do not carry over. Standard credits are added each month and stay until you use them. Trial credits expire when the trial ends. Credits you buy as a top-up are kept separately from plan credits, are not reset at the end of a billing period and do not expire.

Any signed-in account can buy top-ups. Purchases are subject to limits and security checks, including a verified email address, rate limits and fraud screening, and accounts without a paid plan or with a short payment history have lower limits. Auto-refill is optional and off by default. If you turn it on, you choose the balance that triggers a refill, the refill amount and a monthly spending limit of up to $1,000. Auto-refill charges your card only while your subscription is active, and an account is refilled at most 5 times in a calendar month and at most once an hour.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Generate or distribute harmful, offensive, or misleading content
  • Impersonate others or misrepresent your identity
  • Spam or send unsolicited communications
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to systems
  • Use automated tools to scrape or extract data
  • Resell or redistribute the Service without authorization

6. Content Ownership and Licensing

6.1 Your Content

You retain ownership of content you create or upload to the Service ("Your Content"). By using the Service, you grant us a limited license to process, store, and display Your Content as necessary to provide the Service.

6.2 Generated Content

Content generated by our AI tools based on your inputs is owned by you. You are responsible for reviewing and ensuring AI-generated content is accurate and appropriate before publishing.

6.3 Our Content

The Service, including its design, features, and documentation, is owned by SelfScale and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

7. Third-Party Integrations

The Service integrates with third-party platforms that you may choose to connect: LinkedIn, YouTube (Google), Skool, X (Twitter), Instagram and Facebook (Meta), TikTok, Threads (Meta), GitHub, Notion, Canva and Slack for Post Alerts. Fireflies supports importing selected meeting transcripts, and turning your own lines from them into drafts, using your own Fireflies API key, which is stored encrypted until you disconnect. Ghost supports importing your published posts using your own read-only Ghost Content API key, also stored encrypted until you disconnect. Fathom supports importing selected call transcripts using your own Fathom API key, also stored encrypted until you disconnect. Readwise supports importing highlights from your library using your own Readwise access token, also stored encrypted until you disconnect. Integrations with Wispr Flow, Substack, Google Calendar, Telegram and Kit (ConvertKit) are planned and not yet available. Connecting any platform is optional. What we read from, write to and store for each is described in our Privacy Policy under Connected Accounts.

SelfScale uses YouTube API Services. By using SelfScale's YouTube features you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).

Your use of these integrations is subject to the respective platform's terms of service and developer policies, including the YouTube Terms of Service when you connect YouTube. We are not responsible for the actions or policies of third-party platforms. A platform may change or withdraw the access it grants to services like ours at any time, and features that depend on that access may stop working as a result.

You are responsible for complying with the terms of service of any platform to which you publish content through our Service.

8. AI-Generated Content Disclaimer

Content generated by AI may contain errors, inaccuracies, or biases. You are solely responsible for:

  • Reviewing all AI-generated content before use or publication
  • Ensuring content accuracy and appropriateness
  • Compliance with platform guidelines where content is published
  • Any consequences resulting from published content

We do not guarantee that AI-generated content will be error-free, original, or suitable for any particular purpose.

9. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. You use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELFSCALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless SelfScale and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and data
  • Provisions that should survive termination will remain in effect

You may terminate your account at any time in Settings by choosing Delete account, or by emailing support@selfscale.app from your account email and asking us to delete it.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SelfScale regarding the Service and supersede all prior agreements.
