1. Agreement to Terms

By accessing or using SelfScale ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

SelfScale is a product of AI Training Institute Inc ("we," "us," or "our"), a Delaware corporation. These Terms govern your use of our web application and related services.

2. Description of Service

SelfScale is an AI-powered content creation platform that helps users create, manage, and publish content for their personal brand. Our services include:

  • AI-generated content based on your voice profile
  • Content scheduling and publishing to social platforms
  • Voice profile creation and management
  • AI avatar video generation
  • Analytics and performance tracking

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this age requirement.

4. Subscription and Payment

4.1 Free Trial

New users may receive a free trial period. During the trial, you have access to certain features as specified at signup. No credit card is required for the trial.

4.2 Paid Subscriptions

After the trial period, continued access requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis.

4.3 Billing

By providing payment information, you authorize us to charge your payment method for all fees incurred. Prices may change with 30 days notice.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

5. Acceptable Use

You agree not to use the Service to:

  • Generate or distribute harmful, offensive, or misleading content
  • Impersonate others or misrepresent your identity

  • Resell or redistribute the Service without authorization

6. Content Ownership and Licensing

6.1 Your Content

You retain ownership of content you create or upload to the Service ("Your Content"). By using the Service, you grant us a limited license to process, store, and display Your Content as necessary to provide the Service.

6.2 Generated Content

Content generated by our AI tools based on your inputs is owned by you. You are responsible for reviewing and ensuring AI-generated content is accurate and appropriate before publishing.

6.3 Our Content

The Service, including its design, features, and documentation, is owned by SelfScale and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

7. Third-Party Integrations

The Service integrates with third-party platforms including Google, LinkedIn, YouTube, and others. Your use of these integrations is subject to the respective platform's terms of service. We are not responsible for the actions or policies of third-party platforms.

You are responsible for complying with the terms of service of any platform to which you publish content through our Service.

8. AI-Generated Content Disclaimer

Content generated by AI may contain errors, inaccuracies, or biases. You are solely responsible for:

  • Reviewing all AI-generated content before use or publication
  • Ensuring content accuracy and appropriateness
  • Compliance with platform guidelines where content is published
  • Any consequences resulting from published content

We do not guarantee that AI-generated content will be error-free, original, or suitable for any particular purpose.

9. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. You use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELFSCALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless SelfScale and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and data
  • Provisions that should survive termination will remain in effect

You may terminate your account at any time through your account settings.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SelfScale regarding the Service and supersede all prior agreements.
